Hi! I am new the forums and am hoping to jump right in with questions to assist in my research. I am a preschool teacher and have been on CA SDI since May 25th due to a knee injury. I fell down the stairs in my home and reaggrivated(sp?) a past knee injury from 15 years ago when I played division 1 basketball.

My boss forced my hand and pushed me to go on SDI stating there was no modified work conditions for me while I attempt rehab. I could see her point in that our job involves standing, squatting, kneeling, etc. all the things I was restricted from doing :0)

I eventually had to have extensive knee surgery Aug 1st that involved drilling of the bone and meniscus removal. At this point in time, I am still on SDI and my recovery could continue for another 5+ months.

At this point in time, my Dr. is advising me to go into another line of work (basically a desk job.) I am still technically employed at my job and my boss has been patient about my medical leave even though I have informed her that I might not be able to return for many more months.

So my questions are...

1. If my boss continues to keep my employment open, but I am unable to return in full capacity what are my options?

2.I do not want to quit because this would negate any opportunities for unemployment correct?

3.If she doesn't fire me or offer a position I am physically capable of what do I do?

Thanks in advance for any assistance you can provide. I am willing to read and research if anyone can help point me in the right direction.

Dear Shanney27:

ADA allows you to request "reasonable accommodation" which may mean some other postion that you can perform the tasks required. You may want to
consider this option, especially since you enjoy working there some much, and you are not really sure how long you will not be able to perform the tasks you mentioned.

If you had to quit because of your impairment, and you continue having that disability/ limitations, that prevent you from doing any work, UIB would not be an option for you. That program does require that you are ready to work and are looking for work, no real restrictions on the kind of work you are looking for. It may be that you need to make a determination, for yourself, about the kind of jobs tasks you can perform, and decide the kind
of work you are looking for.
